Court of Final Appeal rules surgery requirement for ID gender marker unconstitutional
2023 China court ruling Protective Enacted Legislation
Hong Kong's Court of Final Appeal ruled on February 6, 2023, that the requirement for full gender reassignment surgery to change the gender marker on identity cards is unconstitutional. The ruling came after a legal battle initiated in 2017 by transgender man Henry Tse and others, who challenged the policy. The court found the requirement violated the Hong Kong Bill of Rights, as it imposed an unacceptable burden on transgender individuals.
